COBRA Penalties and Enforcement can be costly


There are several penalties, levied by different entities, for failing to comply with COBRA.

Internal Revenue Service

$100/day per violation up to

$200/day per family.

 

ERISA

Up to $110/day per beneficiary - no family maximum.

 

Court Awarded Damages

>  Monetary damages awarded by

>  Attorney fees awarded by the

    court.
